The Telephone Consumer Protection Act or the TCPA was enacted to protect you from unwanted telephone solicitation and using automated telephone systems. The Do Not Call List is a part of the TCPA . There are other aspects of the TCPA that protect people. There are however a few exceptions to the TCPA that are important to note: It does not apply to business lines; political organizations may still call; nonprofits may still call you; if you have a previous business relationship with the company; and someone may still receive calls from bill collectors. Companies must honor the National Do Not Call list. By signing onto the National Do Not Call List, a person can limit the solicitation calls they receive from certain companies. Under certain circumstances, the DNCL prohibits company and individuals from soliciting individuals under certain circumstances. The TCPA required solicitors to maintain a Do Not Call List for their company. If contacted by a company you may request to be added to their specific do not call list and inform them if you are part of the national do not call list.
If someone solicits you they must provide certain information including: the name of the person or entity on whose behalf they are calling, and a number where the person or entity may be contacted.
Solicitors may not contact residences and use an artificial voice or recording. Additionally, Solicitors may not contact a residence before 8 a.m. or after 9 p.m.
If a company violated the TCPA you may sue the company or individual. The max you can receive in monetary value is $1,500 per violation or you may also seek to recover the actual loss you can prove, whichever is higher. You may also seek an injunction against the company or the individual.
